Fire Department Face Gambling And Alcohol Charges
The Salisbury Volunteer Fire Department will be facing charges for reportedly fostering gambling and unlicensed sale of alcohol at a poker tournament held in November of 2005.
Erik Michael Robertson, 26, and Sidney G. Mull, 24, were freed from related charges at a preliminary hearing, according to District Judge Sandra Stevanus of Confluence. Robertson and Mull sold beer without licenses at the poker fundraiser, according to authorities.
A liquor enforcement officer paid a small fee to get into the Salisbury Volunteer Fire Department fire hall where a Texas Hold'em poker tournament was being held Nov. 19, and made a "controlled buy" of alcohol, according to a probable-cause affidavit.
Criminal charges against the fire department were filed in September by the state police Bureau of Liquor Control Enforcement. According to District Attorney Jerry Spangler, the district attorney's office requested that charges against the firefighters be dropped.
"Our past practice has been to proceed with criminal sanctions (only) against the departments," he said.
Most likely, the fire department will be placed into the Accelerated Rehabilitative Disposition, a program for first-time offenders.
"This is an opportunity for the defendant to show they will not re-offend," Spangler said.
